ICE & CBP’s Twin Cultures of Impunity: Is Reform Possible?

ICE has operated without accountability since it was established in the US post-9/11 militarization of the border. CBP’s origins, dating back before the 1924 establishment of the Border Patrol, have deep roots in white supremacy and racial exclusion. The system-wide culture of impunity unleashed during the Trump administration fit these agencies like a glove. But their continued disregard for human rights now belongs to Biden, just as they were Obama's before him.

Are they agencies gone rogue? Or are their abuses merely the work of bad actors, a few agents turning reins into whips and human restraints into instruments of torture?

We invite you to unpack these questions, and more, with three of the impacted individuals; their attorney Fatma E. Marouf, director of the Texas A&M School of Law Immigrant Rights Clinic; and author and member of Witness's leadership team, Sarah Towle, who uncovered the heretofore untold tale of a routine tactic used by ICE during deportation proceedings to threaten, coerce, and punish asylum seekers who dare to plead for justice. Their story is the subject of a new legal complaint to be filed with the DHS Office of Civil Rights and Civil Liberties on October 13th -- the one-year anniversary of the first flight DHS sent back to war-torn Cameroon in which this technique was used in violation of myriad US laws and human rights conventions.
